SwordSec Terms of Service

1. Introduction

These Terms of Service (“Terms”) constitute a legally binding agreement between SWORDSEC SİBER GÜVENLİK TEKNOLOJİLERİ A.Ş. (“Company,” “we,” “our,” or “us”) and you (“User,” “you,” or “your”) regarding your use of the SwordSec mobile application (“App”) and data breach service (“Service”).

2. Acceptance of Terms

By downloading, installing, or using our App and Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use our App or Service.

3. Service Description

SwordSec provides a breach detection and web protection service.

4. Account Registration

4.1. To use our Service, you may need to create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Promptly update any changes to your account information
Accept responsibility for all activities that occur under your account

4.2. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription and Payment

5.1. Service fees and subscription terms are displayed in the App before purchase.

5.2. All payments are processed through Apple’s App Store and subject to Apple’s terms and conditions.

5.3. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

5.4. You can manage and cancel your subscription through your Apple App Store account settings.

6. Acceptable Use Policy

6.1. You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe upon intellectual property rights
Transmit malicious software or content
Conduct spam or fraudulent activities
Harass, abuse, or harm others
Access unauthorized systems or networks
Interfere with the Service or other users’ access

6.2. We reserve the right to investigate and take appropriate legal action against violations.

7. Privacy and Security

7.1. Our collection and use of your information is governed by our Privacy Policy.

7.2. While we implement security measures, no internet transmission is completely secure. You use the Service at your own risk.

8. Service Availability and Modifications

8.1. We strive to maintain Service availability but do not guarantee uninterrupted access.

8.2. We may:

Modify or discontinue features
Perform maintenance
Update the App
Change server locations

8.3. We will make reasonable efforts to notify users of significant changes.

9. Intellectual Property

9.1. The App, Service, and all related content are our exclusive property.

9.2. You receive a limited, non-exclusive, non-transferable license to use the App and Service for personal use.

10. Disclaimer of Warranties

10.1. THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.

10.2. We do not warrant that:

The Service will be uninterrupted or error-free
Defects will be corrected
The Service is free of harmful components
The Service will meet your specific requirements

11. Limitation of Liability

11.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Direct, indirect, incidental, special, or consequential damages
Loss of profits, data, or use
Service interruptions
Third-party actions
Matters beyond our reasonable control

11.2. Our total liability shall not exceed the amount paid by you for the Service in the past 12 months.

12. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising from your use of the Service or violation of these Terms.

13. Term and Termination

13.1. These Terms remain effective until terminated.

13.2. We may terminate or suspend your access:

For Terms violations
By your request
For Service discontinuation
For any reason with reasonable notice

13.3. Upon termination:

Your access rights end
You must cease using the Service
Applicable Terms provisions survive

14. Changes to Terms

14.1. We may modify these Terms at any time.

14.2. We will notify you of material changes through the App or email.

14.3. Continued use after changes constitutes acceptance of modified Terms.

15. Governing Law and Jurisdiction

15.1. These Terms are governed by Turkish law.

15.2. Disputes shall be resolved in the courts of Ankara, Turkey.
